Terms of service

1. Who we are
MISSIN is provided by MISSIN LIMITED (MISSIN, we, us), a company registered in Scotland, registered office 20 Arthur View Terrace, Danderhall, Dalkeith, EH22 1NT. You can reach us at Sam@missin.co.uk.
These terms apply to the MISSIN app, the MISSIN Shopify apps, the MISSIN API, and the MISSIN SDK, CLI and MCP server (together, the service). By creating a workspace, installing a MISSIN app or using an API key, you accept them.
2. Who may use MISSIN
MISSIN is a service for businesses. You may use it only for a business you run or work for, and you must be allowed to accept these terms for that business. In these terms, you means that business.
3. Your account and workspace
- You sign in through our identity provider, with an email address and password or with a Google account.
- Everything you do in MISSIN belongs to a workspace. A workspace has an owner, and can have admins and members. People join by an invitation link, which can be used once.
- You are responsible for the people you invite and for what they do in your workspace. Keep sign-in details private and tell us if you think someone has used your account without permission.
4. Plans and billing
- MISSIN has a Free plan and paid plans (Basic, Pro and Max). What each plan includes and costs is shown on the pricing page and in Settings › Billing.
- Paid plans are billed in advance, monthly or yearly, through Stripe. Some features, such as Mend judging orders and capturing partners' posts, use credits. The Free plan comes with a one-off welcome credit. You can buy more credit as a top-up. On a paid plan, usage beyond your balance is charged as overage. Overage is capped each month at a limit set by your plan, shown in your billing settings. The Free plan has no overage: when its credit runs out, usage stops until you add more.
- Prices are in pounds sterling (GBP). MISSIN is not registered for VAT, so no VAT is charged.
- You can change or cancel your plan at any time in Settings › Billing. When you cancel, you keep access until the end of the period you have paid for. We do not refund part of a period, or included usage you did not use.
- Credit you buy as a top-up never expires and is not refundable.
- Nothing in this section stops a refund the law requires, for example when we billed you in error.
- If a renewal payment fails, Stripe retries it and your workspace keeps its paid plan meanwhile. If every retry fails, the subscription is cancelled and the workspace moves to the Free plan. The unpaid invoice stays due. Nothing is deleted.
5. Connecting your store and tools
You can connect accounts you hold with other providers, such as a Shopify store, Stripe, an email tool (for example Klaviyo or Mailchimp) or an ad account. When you connect one, you allow MISSIN to read from it and write to it as the connection screen describes, on your instruction. Your use of that account stays under your agreement with its provider. You can disconnect it at any time.
6. Your responsibilities to your customers
When MISSIN handles the personal data of your customers and website visitors, you decide how it is used and MISSIN processes it for you. The data processing agreement forms part of these terms and sets out how.
- You must have a lawful basis for collecting your customers' data, and tell them about it in your own privacy notice.
- Your forms, waitlists, incentives and discounts are your offers. You set their terms, publish them, and honour every code or reward MISSIN issues for you.
- MISSIN offers template promotion terms and privacy notice wording in the waitlist consent settings. They are a starting point, not legal advice: you are responsible for the wording you publish.
- You must respect each person's choices: use a waitlist for marketing only with that person's consent, and honour every unsubscribe.
- You must not use a form to collect special category data (such as health, religion or ethnicity) or payment card details.
7. Partners and their posts
You can add the partners who post about your business. MISSIN collects their public posts and handles so it can credit the orders those posts earn. Add only partners you work with, and only their public accounts.
8. Acceptable use
You must not:
- break the law, or help anyone else to, through the service;
- send spam, or contact anyone who has not agreed to hear from you;
- upload malware, or try to get into another workspace, our systems or anyone's account;
- get around a plan limit, a rate limit or a security control;
- copy, resell or rebuild the service, except as these terms allow;
- use the service to infringe anyone's rights.
9. API keys, SDK, CLI and MCP
- An API key belongs to one workspace and has an access level: Read, Write or Admin. We show the full key once, when you create it, and store only a hash of it. Keep it secret and revoke it in Settings › Developers if it leaks.
- Anything done with your key is done by you. That includes an AI assistant you connect through the MISSIN MCP server: it can do whatever the key's access level allows, including starting a paid capture.
- The SDK, CLI and MCP server are licensed for use with the service only, as their licence file says. You must not copy, change or redistribute them except as that licence allows.
- We may limit the rate of requests to keep the service working for everyone.
10. Your data
The data you and your customers put into MISSIN stays yours. You allow us to store and process it only to run the service for your workspace, as the privacy policy and the data processing agreement describe. We do not use one workspace's data to improve Mend for other workspaces, we never sell it, and we never use it to train third-party AI models.
11. Availability and changes to the service
The Free, Basic, Pro and Max plans are provided as available. We work to keep MISSIN running, but we do not promise it will always be available or free of errors, and these plans have no service-level commitment or service credits. An Enterprise customer may agree a service level in its own contract.
We may change or remove features. If we remove a feature you pay for, we will tell you first. Features marked beta may change without notice.
12. Liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.
- Subject to that, we are not liable for any indirect or consequential loss, or for any loss of profit, revenue, data or goodwill, however it arises.
- Subject to that, our total liability to you for all claims arising out of or in connection with the service or these terms, whether in contract, delict (including negligence) or otherwise, is limited to the fees you paid us in the 12 months before the event that gave rise to the claim. For a workspace on the Free plan, that is £0.
- Attribution is an estimate. MISSIN shows how it reached each result, but you are responsible for the business decisions you make with it.
13. Ending the service
- The workspace owner can delete a workspace at any time in Settings. Deleting it cancels its subscription straight away, with no refund for the rest of the period, and marks the workspace deleted. We keep its data so it can be restored, and delete it within 30 days if you ask us in writing. Deletion on request is done by hand today.
- A Shopify store that still has a MISSIN app installed keeps being processed after its workspace is deleted, until you uninstall the app. Shopify then asks us to erase that store's data, and we do.
- Before you leave, you can download your waitlists as CSV and any customer data request export. Up to 30 days after you cancel, you can also ask us for an export of your workspace's core data: campaigns, forms and their responses, discount codes, orders and attribution results. Partners' social posts are not included.
- We may suspend or close a workspace that breaks these terms or does not pay. We will tell you first unless the breach is serious or the law prevents us.
14. Changes to these terms
We may update these terms. We will email workspace owners 30 days before a material change takes effect. A change needed for legal or security reasons may apply sooner. The date at the top of this page shows when they last changed.
15. Governing law
These terms are governed by the law of Scotland, and the Scottish courts have jurisdiction over any dispute about them.
